Acceptable Use Policy
01 // Purpose
MEnterprise Firm Inc. provides payment infrastructure and checkout technology to merchants operating in high-risk and regulated industries. We serve a broad range of legal businesses that mainstream payment platforms refuse. This policy defines the boundaries of acceptable use to protect our infrastructure, our other merchant clients, our ISO partner relationships, and our ability to continue operating.
This policy is not intended to restrict legitimate high-risk commerce. It is intended to prevent our infrastructure from being used to facilitate fraud, illegal activity, or activity that creates disproportionate risk to the network.
02 // Permitted Uses
AltPay Rails and associated services may be used by merchants selling legal products and services who meet all of the following criteria:
- The merchant’s business is legally permitted in the jurisdiction(s) where it operates
- The merchant holds all required licenses, permits, and certifications for their industry
- The products or services being sold comply with applicable federal, state, and local laws
- The merchant’s website meets applicable compliance requirements for their product category
- The merchant’s chargeback ratio remains below 1.0% of monthly transactions
- Transaction activity is consistent with the volume and business description provided in the merchant application
Approved Product Categories
The following categories are permitted subject to the criteria above and applicable state law:
- Kratom products (compliant with applicable state laws, with required disclaimers)
- Hemp, CBD, THCA, Delta-8, Delta-9, and related botanical products (Farm Bill compliant)
- Legal firearms, ammunition, and accessories (FFL holders as applicable)
- Dietary supplements and nutraceuticals
- Vape and nicotine products (legal age-restricted sales with proper verification)
- Peptides and research chemicals (sold for legitimate research purposes with appropriate disclaimers)
- Legal cannabis dispensaries (in states with legal adult-use or medical programs)
- Standard e-commerce, dropshipping, and retail
- Services businesses of all types
03 // Prohibited Uses
Prohibited Product Categories
- Illegal drugs, controlled substances, or synthetic cannabinoids not covered under the Farm Bill
- Products containing synthetic opioids, fentanyl analogues, or Schedule I substances
- Firearms sales without FFL license where required
- Child sexual abuse material or any content sexualizing minors — zero tolerance, immediate law enforcement referral
- Human trafficking, escort services, or non-consensual content
- Counterfeit goods, pirated software, or stolen intellectual property
- Unlicensed pharmaceuticals or prescription drugs without valid prescription process
- Products making fraudulent health claims (e.g., products claiming to cure or treat diseases)
- Malware, spyware, viruses, or hacking tools
- Pyramid schemes, multi-level marketing programs with illegal structure, or Ponzi schemes
Prohibited Activities
- Processing transactions for businesses other than the registered merchant (factoring)
- Using our infrastructure to process transactions for a different business than described in the merchant application
- Structuring transactions to avoid detection thresholds (smurfing)
- Money laundering or processing proceeds of illegal activity
- Using false or misleading product descriptions to circumvent risk screening
- Operating in states where your product is explicitly banned without disclosing this to MEnterprise Firm Inc.
- Exceeding chargeback ratio thresholds without implementing remediation measures
- Reselling or sublicensing access to AltPay Rails to third parties without written authorization
04 // Chargeback Policy
Chargebacks represent a significant compliance risk for all parties in the payment ecosystem. As a condition of using our services:
- Warning threshold: Chargeback ratio exceeding 0.75% in any calendar month — we will notify you and require a written remediation plan
- Suspension threshold: Chargeback ratio exceeding 1.0% in any calendar month — services may be suspended pending review
- Termination threshold: Chargeback ratio exceeding 1.5% for two consecutive months — services will be terminated
These thresholds align with card brand rules (Visa and Mastercard both enforce a 1.0% threshold for standard merchants, lower for some high-risk categories). Exceeding them does not just create risk for you — it creates risk for the entire merchant network on our infrastructure.
We will work with merchants experiencing elevated chargebacks to identify causes and implement solutions before taking action. Termination is a last resort.
05 // Compliance with State Laws
It is your responsibility to monitor the legal status of your products in every state where you sell. We operate KratomBans.com and CBDBans.com as public resources to help merchants track legislative activity, but these tools do not substitute for independent legal counsel.
If your product becomes illegal in a state where you operate, you must:
- Stop shipping to that state immediately upon the law’s effective date
- Update your website to reflect geographic restrictions
- Notify MEnterprise Firm Inc. if the restriction materially affects your processing volume
Continuing to process transactions in violation of applicable state law may result in immediate service termination.
06 // Enforcement
Monitoring
We conduct periodic compliance scans of merchant websites. These scans check for compliance with processor underwriting requirements and this AUP. You will be notified of any issues found and given a reasonable opportunity to correct them before enforcement action is taken.
Enforcement Process
For non-critical violations:
- Written notice of the violation with a description of the issue
- 14-day cure period to remediate
- If unresolved, service suspension pending resolution
- If still unresolved after 30 days, termination
For critical violations (illegal activity, fraud, prohibited products, chargeback abuse):
- Immediate service suspension
- Notification sent to merchant email on file
- Referral to law enforcement if required by law
- No cure period — termination is immediate
Reporting Violations
If you are aware of another merchant using our infrastructure in violation of this policy, report it to cash@mef.money. We take reports seriously and investigate promptly.
